CLARIFICATION TEXT ON THE PROTECTION OF PERSONAL DATA REGARDING TELEPHONE CALL RECORDINGS

 

Pursuant to  Article 10 of Law No. 6698 on the Protection of Personal Data(“Law”) and in accordance with the Communiqué on Principles and Procedures for the Fulfilment of the Obligation to Inform, TUSAŞ – Türk Havacılık ve Uzay Sanayii A.Ş. (Turkish Aerospace) fulfils its obligations to inform data subjects in diligent and conscientious manner in the processing and storage of personal data.

  1. PROCESSED PERSONAL DATA, PURPOSE OF PROCESSING AND LEGAL REASONS

In the course of your telephone contact with Turkish Aerospace, your voice recording and any personal data you may share during the call, such as your name and surname, may be processed within the framework of Articles 5 and 6 of the Law No. 6698 for the purposes and legal grounds listed below:

  1. Addressing the caller correctly,
  2. Ascertaining the identity of the caller,
  3. Ensuring transaction security,
  4. Using as evidence in potential future disputes,
  5. Recording, reviewing, and, where necessary, responding to notifications such as requests, suggestions, feedback, complaints, and objections within the scope of conducting the activities carried out by Turkish Aerospace and executing the related business processes; monitoring service quality; planning or execution of activities to ensure business continuity; and ensuring emergency management,
  6. Ensuring legal security, and
  7. Fulfilling legal rights and obligations.

  8. RETENTION PERIOD, ERASURE, DESTRUCTION, AND ANONYMIZATION OF PERSONAL DATA

Voice recordings obtained through your telephone contact with Turkish Aerospace  are stored on Turkish Aerospace servers for a maximum period of 6 (six) months from the date on which the purpose of processing ceases to exist. At the end of this period, or in any case at six month intervals, such recordings are erased, destroyed/destructed, or anonymized by preparing periodic destruction reports in accordance with Article 138 of the Turkish Criminal Code Law No. 5237 and Article 7 of Law No. 6698.

The retention periods set out above may be extended where legitimate requirements arise, such as Turkish Aerospace’s legal obligations or legal dispute or investigation processes.

 

  1. TRANSFER OF PERSONAL DATA

Personal data processed by Turkish Aerospace may be transffered to legally authorized public authorities  for the purposes set out in the Law No. 6698 and in Section 2 of this Clarification Text, where one of the conditions specified in Article 5 of the Law No. 6698 is met.. Access to information obtained through voice recordings is  restricted to a limited number of Turkish Aerospace employees, and such employees undertake to protect the confidentiality of the personal data they access through confidentiality agreements.

Except for the situations listed above, your voice recording data shall not be shared with third parties or transferred abroad.

 

  1. METHOD OF COLLECTION OF PERSONAL DATA

Your personal data is collected and retained by Turkish Aerospace through the switchboard system and solely by means of voice recordings during your telephone call. Such data is stored on Turkish Aerospace servers by taking all necessary technical and administrative measures to ensure an appropriate level of security in accordance with Article 12 of the Law No. 6698, in order to prevent unlawful processing of personal data, prevent unlawful access to personal data, and ensure the safeguarding of personal data.

 

  1. RIGHTS OF DATA SUBJECTS AND EXERCISE OF SUCH RIGHTS

 

As a data subject, your request containing the necessary information that will allow you to identify yourself and your explanations regarding your right to exercise the rights specified in Article 11 of the Law No. 6698; may be submitted by filling out the Data Subject Application Form at www.tusas.com/en/legal/pdpl,  either in writing or through your registered e-mail address, secure electronic signature, mobile signature, or the electronic mail address previously notified to us and registered in our system, to the following addresses:
